Is it legal to have pets at a child daycare?
My wife and i have found a daycare we like but they have a dog and a cat. This was fine with me at first but now my son (18 months) was clawed in the back of the head by the cat. Are there laws against this?

I run an in home daycare, although I don't have any pets, it is legal. You are allowed to have pets, you have to be upfront with the parents about the pets in the first place, they have to be up to date on all vaccinations. She is allowed to have these pets and you are the person under the assumed risk if you know in advanced about the pets. You have a right not to put your child in a daycare that has pets in the first place if you are afraid of these accidents. Unfortunately you can never predict the behavior of a pet and of a child, sometimes a pet may react in defense from a toddler or the pet may attack for no reason. If you are this concerned about it and don't feel as if your child is safe I would suggest to look over your contract you signed with your child care provider and find a new place. It may be that you have a 30/60/90 day contract in which you are responsible for payment, this gives the provider time to fill the spot as well as give you time to find a daycare that may make you feel more comfortable. if its a private daycare, like out of someones home, then yes it is legal. if you have a problem with it, then you can request for them to not let your son near the animals and to pay for any medical bills (though i dont think there will be any if its just a scratch), also get down to what happened, was this a random thing or was your son teasing the cat.

You need to call the county's Public Health office where the daycare is. If I were you I would ask for documentation of the cat and dogs rabies vaccination upon your return. Where I am located, the only pets that are allowed are fish. The public health facility that inspects the daycare will be able to tell you if they are illegally keeping the pets there.

It is not against the law to have pets at a daycare. It is usually recommended that the pets are kept in an area away from the children though. If your child was injured, the daycares insurance should pay for his injuries.
