Until you go to court and get visitation worked out, he has a right to see his child but also should be paying child support. If he doesn't want to pay child support then ask if he is willing to sigh away his parental rights.
Depending on what his crime was and how long he has been out of prison, you may be able to get supervised visitation only. You really need to call legal aid or get a lawyer on your own to help you with this. Don't try and do it on your own.
