Who has more custody, a mom or a dad.?
A friend of mine (the dad), just had a baby a few months ago with his gf. His girlfriend and him are now having issues. The dad wants to see the baby and sometimes the mom gets really upset and tries to deny him the baby. Can she do that, would they have equal right to the baby if they were to take this to court?

The mom usually gets custody of the baby unless she's unfit somehow. If they can prove she neglets the baby, she's a druggie, alcoholic etc then the father will get custody.

If the mother wrongly tries to deny the father of visitation, he can take her to court. He has the legal right to see his child.
On a personal note, if this woman is your trend you should tell her to grow up.mom and dad don't like each other , whatever. It ibso selfish of her to deny the child of it's father out of spite.

In an ideal society, babies would be born to parents who could agree on these types of things. However, the truth is that it isn't uncommon for babies born to unmarried parents to have issues with who gets to have the baby when. If they can't work this out between the two of them than your friend is going to have the best success with enlisting the help of a lawyer and filing for custody. Whether it is right or not, the law typically allows mothers to have more custody than fathers. Equality isn't always the end result of these types of legal matters. At this point in time, the law would be on the side of the baby's mother and she can deny the father access since he doesn't have any custody or visitation decree. He'll probably have to pay for a paternity test since that is often one of the first things that has to be proven before a judge will go forward with deciding the custody/visitation schedule. The best case scenario would be that both of them would be mature enough to decide between themselves what is best for their child, but few couples are able to do this without going to court. Unless the mother is deemed unfit, she'll most likely be the one that has the most custody of the baby.
It depends on your culture. But in USA mom always get custody of the child. The only way she doesn't get custody is if the father can prove the mother is an unfit parent (and even then some judges will still give the mother custody even if she's a junkie whore). She can't stop him from visitation if it is court ordered, otherwise she'll be found in contempt and end up in the slammer. If there isn't a court order in place then she could probably withhold the child from the father. My advice is get a lawyer and take the mother to court for visitation rights (to be determined by a judge).
As long as he is able to see the baby an equal amount of time and the judge sees him as an equally fit parent, he should have equal custody.
