Can a father win custody over his child?
the reason being is cause I don't think I can be with his mother but if I choose to separate she will make it to where I can't see him. Where i wouldn't stop her from see him

She cannot legally stop you from seeing him,you could try for full custody but most courts will not grant it unless you have solid evidence that she is an unfit mother.
You need to get yourself a lawyer and make sure that a court agreement is set up for visitation so that you know you are definitely going to have a solid,legal plan in place to see him,the court is interested in what is best for the child and most will not remove a child from a mother who is capable of looking after him but they also respect that a child has a right to know both parents and have both involved.

As long as your name is on the birthcertificate, or you get a dna test to prove paternity, you can go to court to get scheduled visatation, if she still dosent let you see him on your scheduled visatiation days she will be in contempt of court and could possibly go to jail. I would advise you to get an attorney as soon as the child is born and start the process of getting visatation right away.
Yes. Any parent can win full custody or equal custody of the child in court. You would have to take her to court, but make sure that you have a very good explanation why its not safe for the child to be around her. For example, drug use or alcohol use or anything else that might endanger the child. Or none of that happens, then try to think of something to use against her such as financial problems or her habits, or something you really think is good to use against her. yes of course. fathers have just as much rights as a mother. some reason it seems as though people think woman are more capable of taking care of kids but it is 2011 more men are taking care of kids and home while the mothers work. you just need to have a good character in front of the judge and make sure you have people there to agree with you.

Why don't you try for joint custody where you get him during the weekends, or 50% of the time. You'll need to see a lawyer, but fathers definitely have rights.
